SDNY COURTHOUSEOctober 7 – Calvin Darden Jr. goes on trial for defrauding NBA player Dwight Howard to convince him to buy the WNBA team Atlanta Dream. Inner City Press reports on the trial. Thread from September 30th:

AUSA: Did you ever meet directly with Calvin Darden?

Witness Schmidt: No, but these are my text messages about 10(b)5(1) sales contracts and Calvin Darden’s declaration of loyalty

AUSA: What is that?

Schmidt: A statement from Wells Fargo called Calvin Darden.

AUSA: Did Dwight Howard pursue the investment?

Schmidt: Yes, this is my client Dwight David Howard II’s referral for the marketing firm associated with the WNBA’s Atlanta Dream

AUSA: Has Mr. Howard’s line of credit been increased to $10 million?

Schmidt: Yes. Here he wired Legacy AC LLC to try to complete the purchase of the Atlanta Dream. But we learned that as an active NBA player, Dwight couldn’t own the Dream – so he had to act as a creditor.

Then the conviction of CALVIN DARDEN, JR. for his role in defrauding former National Basketball Association players Dwight Howard and Chandler Parsons of $8 million. The defendant was found guilty after an 11-day jury trial before U.S. District Judge Vernon S. Broderick.

The case is United States v. Cohen et al., 1:23-cr-134 (Broderick)
