To reduce public nuisance and safety concerns, the Wedowee City Council has passed an ordinance regulating flea markets and garage sales within city limits.
The issue was brought up at the last meeting by Police Chief Robbie Taylor. The chief said he had visited other cities and the downtowns looked more like a flea market. The council is asking the chief to pass an ordinance to keep the downtown free of clutter and preserve its beauty.
At the Council meeting last week, the regulation was introduced and passed unanimously. In an official vote, the Council voted unanimously to adopt the regulation. In summary, the regulation includes the following:
- Flea markets may not take place on more than four days in any calendar year and may not last longer than two consecutive days.
- All flea markets shall be limited to that portion of the front yard which is at least 20 feet from the property line on all sides and at least 15 feet from any roadside, curb or sidewalk.
- Sales are not permitted on public sidewalks.
- Religious and charitable organizations are exempt and may conduct sales on their own property or at other locations with the consent of the property owners.
- A maximum of two signs may be placed on the premises of the point of sale.
- Signs may not be attached to electricity pylons.
- The size of the signs is limited to 0.33 square meters and they may not be displayed more than two days before the sale.
- There are no flea markets on Sundays unless there is written permission from the mayor and the municipal council.
- Events planned or approved by the city are exempt from the regulation.
Violations of the regulation may result in the following penalties:
- First offense: $100
- Second offense: Fine not exceeding $300
- Third offense: $500 fine, court appearance, and up to six months in prison.
A complete copy of the ordinance is available for inspection at the town hall.
Other Council matters:
- Approved a modification to the grant fund for works on the sewer system and lagoon.
- As the architect announced, the plans for the new town hall are ready. The plans will be forwarded to the state building commission.
